On February 20th, 2020, we reported on Take-Two Interactive sending law firm Frankfurt Kurnit Klein + Selz after Red Dead Redemption 2 modders Unlosing and Jedijosh920 for their “Hot Coffee” mod. Well, it looks like the law firm Frankfurt Kurnit Klein + Selz has done its job and has the two modders turning the once available Hot Coffee mod in “hidden mode” on NexusMods.
If you would like to play sleuth and see what has gone down after the interaction between Frankfurt Kurnit Klein + Selz and Unlosing and Jedijosh920, which unfolded last week, then you can head on over to the now missing mod’s NexusMods page to see for yourself.
If you can’t reach the above link or see the above image, it displays that the Hot Coffee mod is “hidden” ever since February 23rd, 2020. However, if this mod has your curiosity, you can check it out right here courtesy of YouTuber Cad5150:
As you can see, the mod allows the player to pick up a woman or a prostitute and have sex — except there’s no nudity, and it uses assets/sounds from the game itself.
Unlosing and Jedijosh920 tried to explain the above to a representative of law firm Frankfurt Kurnit Klein + Selz, but the rep insisted that the mod infringes and violates the game’s End User License Agreement (EULA) and Code of Conduct (CoC) as well as a host of other legal terms.
In addition to the above, the rep for the law firm highlighted that the sexual content present in the mod was the biggest offender, stating that it raises “particular concern.”
Well, as of today, website pcgamesn.com reached out to the modders and received the following answer from Unlosing:
“I was a bit surprised and didn’t expect Take-Two to worry about a single-player mod this much. I find it crazy how Rockstar Games can add hookers to its games, but when someone uploads a mod (not even of the same quality) it’s suddenly ‘inappropriate.’”
The website asked if this was fair what Take-Two Interactive and Rockstart Games have imposed on the mod, Unlosing had this to say:
“The mod doesn’t contain any nudity or nude models, and only uses assets that are still in the game. The animations are from the drunk bar mission with Lenny (which are still in the game), and the ‘moaning’ noises are simply the sounds the [character models] make when they get injured. Also, they mention ‘online services’, however this mod is only available for single-player. To answer your question: no, I don’t think it’s fair.”
Finally, here’s what the rep for Frankfurt Kurnit Klein + Selz had to say to Unlosing and Jedijosh920 last week regarding the mod and its sexual content, which is the primary reason why the mod is now taken down:
“[…] Part (i) of Rockstars EULA license conditions prohibits acts like decompiling, preparing derivative works based on, or otherwise modifying the Software. Part (M) prohibits violating the Code of Conduct. The Code of Conduct for online services includes a prohibition on users creating, uploading, or posting material that is vulgar, obscene sexually oriented, or inconsistent with community standards.
The animation and all of the software’s content is also protected by copyright law, and the mod infringes on the copyright holder’s exclusive rights to reproduce, distribute, and prepare derivative works.
That being said, frankly, it is the sexual content of the Hot Coffee mod that is causing particular concern here and the reason for why the mod needs to be taken down and disabled immediately.”
